국군통수권

1. 개요

국군통수권(國軍統帥權)은 대한민국 헌법 제74조가 정하는 바에 따라 대한민국 대통령에게 주어지는 대한민국 국군에 대한 통수권(統帥權)으로, 나라의 군대 전체를 지휘, 통솔하는 권한을 말한다. 외국의 군 통수권과 그 형태에 대해서는 통수권 문서 참조.

2. 국군통수권자 (대한민국 대통령)

제74조 ① 대통령은 헌법과 법률이 정하는 바에 의하여 국군을 통수한다.

대한민국의 국군통수권은 대한민국 대통령 고유의 권한이다. 대한민국 대통령은 대한민국 국군의 통수권자로 모든 대한민국 군인의 직속상관임이 헌법재판소에 의해 확인된 바 있다(2013헌바111).[1] 하술한 법적 근거 문단도 참조.

대통령 유고시에 역할을 이어받는 대한민국 대통령 권한대행도 원칙적으로는 국군통수권자이다. 단, 직선제로 선출되어 민주적 정당성을 가지는 대통령이 아니라 어디까지나 임명직 출신 권한대행이므로 실제로 군 통수권을 어느 정도까지 행사해야 하는가에 대해서는 학설 간 대립이 존재한다. 제6공화국의 대한민국 대통령 권한대행이었던 고건 전 국무총리와 황교안 전 국무총리는 정통성 문제를 의식해서인지 대행기간 중 군 통수권을 적극적으로 행사하지는 않았다.[2]

민주화 이후 대통령의 연설에서는 대통령이 자기 자신을 지칭하는 표현에서도 국군통수권자임을 확인할 수 있는데 대통령이 받들어 모셔야 하는 일반 국민을 청자로 하는 연설에서는 저라는 표현을 쓰지만[3] 대통령의 지휘 대상인 대한민국 국군 장병을 대상으로 하는 연설은 일단 그 이름부터 대통령님 훈시/말씀이며 대통령은 하급자인 장병에 대하여 나라는 표현을 쓴다. 국군의 날 행사 등에서 이를 확인할 수 있다.

3. 국군통수권의 이양

대한민국 대통령의 모든 권한은 임기 시작과 동시에 발생하며 국군통수권 역시 임기 시작일 0시를 기해 신임 대통령에게 이양된다. 대통령 취임식은 표상적인 행사이므로 식이 실시되는가의 여부와는 관계 없으며, 역대 대통령은 임기가 시작하는 날 0시에 자동으로 통수권을 이양받고 합동참모본부에 첫 번째 지휘 통화 혹은 대통령실 지하 벙커에서 보고를 받음으로써 자신의 통수권을 확인하는 것이 관례이다.

문재인 전 대통령은 전임 대통령의 탄핵으로 인한 유고 상황에서 실시된 제19대 대통령 선거에 따라 2017년 5월 10일, 하루 전 시행된 대통령 선거의 결과를 중앙선거관리위원회에서 의결하여 당선이 확정된 그 시점에 즉시 대한민국 국군 통수권을 이양받았으며 이를 10일 아침[4] 이순진 합참의장과 통화하는 것으로 확인하였다.

이재명 현 대통령도 전임 대통령의 탄핵으로 인한 유고 상황에서 실시된 제21대 대통령 선거에 따라 2025년 6월 4일, 하루 전 시행된 대통령 선거의 결과를 중앙선거관리위원회에서 의결하여 당선이 확정된 그 시점에 즉시 대한민국 국군 통수권을 이양받았으며 이를 김명수 합참의장과 통화하는 것으로 확인하였다.

제74조 ① 대통령은 헌법과 법률이 정하는 바에 의하여 국군을 통수한다.

국군통수권자는 대통령으로 대한민국 헌법과 국군조직법에서 정하는 바에 따라 국군을 통수한다. 헌법재판소의 해석에 의하면, 국군통수권은 용병작용을 위한 군령권과 양병작용을 위한 군정권을 포함한다.

국군통수권은 군령(軍令)과 군정(軍政)에 관한 권한을 포괄하고, 여기서 군령이란 국방목적을 위하여 군을 현실적으로 지휘·명령하고 통솔하는 용병작용(用兵作用)을, 군정이란 군을 조직·유지·관리하는 양병작용(養兵作用)을 말한다.
