일본에 서버가 있는 Misskey 인스턴스.

2. 상세

모든 사용자가 커스텀 이모지 등의 관리 권한을 가지고, 드라이브 1TB를 제공하는 것이 다른 인스턴스와 구별되는 특징이다. 시간대에 따라 로컬 타임라인에 일본어 사용자가 많이 보이는 편이며, 공지도 한국어, 일본어, 영어를 병기하여 올리는 편이다. 다만 상당수의 이용자가 한국어 화자이기 때문에, 운영은 주로 한국어로 이루어진다고 약관에 명시되어 있다.

소프트웨어는 Misskey.io 인스턴스에서 사용하는 Misskey의 포크 버전을 재포크한 것으로 이 버전에 따로 붙은 명칭은 없으며, 주요 개발자는 Astro-CQM과 이성재(Hoto-Cocoa)[1]이다. GitHub 조직은 hotomoe.

홈피에는 공식적으로 미국 와이오밍주에 위치한 이 법인이 운영한다고 적혀 있다. 대한민국 법인인 호토어스 유한책임회사와는 상호가 유사할 뿐 법적으로 관련이 없다. 와이오밍주 정부 기록에 따르면 이 회사는 2022년 3월 23일 최초 설립되었으며, 설립 1년 뒤인 2023년 3월 2일에도 세금 미납으로 인한 연체 경고(Delinquency Notice)를 받았다가 이를 납부하여 해산을 면한 이력이 있다. 그러나 이듬해에도 세금을 납부하지 않아 2024년 3월 2일 다시 경고 처분을 받았고, 이에 대응하지 않아 결국 2024년 5월 9일부로 주 정부로부터 연간 보고 의무 불이행을 사유로 '행정적 해산'(Administratively Dissolved) 처분을 받아 법인 자격이 소멸된 상태이다.[3]

그러나 2024년 5월 24일, 즉 이미 법인 해산 처분을 받아 실체가 소멸된 이후에 제정된 hotomoe의 이용 약관 [4]에는 이 회사가 버젓이 운영 주체로 명시되어 있다. 이미 법인 자격이 상실되었음에도 불구하고, 약관은 여전히 이 법인을 주체로 내세워 이용자에게 콘텐츠 게시 시 거주 국가와 무관한 미국 연방 및 와이오밍주 법률 준수 의무를 부과하고 있다. 또한 대한민국 및 북한 법률의 미적용, 와이오밍주 법원으로의 관할권 지정 등을 명시하는 등 서류상으로는 여전히 해당 법인이 정상적으로 운영되는 듯한 형식을 취하고 있다.

법인은 유한책임회사의 실제 소유주 정보를 공개하지 않아도 되는 와이오밍주 법률을 이용해 익명으로 설립되었는데, 법인 설립 대리인(Organizer)으로 등재된 'Andrew Pierce'와 공식 주소지를 공유하는 법인이 다수 존재한다.[5] 대표적인 사례로 겟 트럼프 스니커즈 닷컴을 통해 도널드 트럼프 대통령의 황금 운동화#를 판매하는 '45Footwear LLC'는 이 법인과 공식 주소지와 대리인이 같다(...). 이러한 점 때문에 실제 운영 주체는 누구인지 알려져 있지 않다.

이후 hotomoe 메인의 문구가 위에서 아래로 바뀌었다.

4. 이용 규칙

이용 규칙의 한국어 번역[7]

0순위 규칙으로 상식적인 행동을 최우선으로 꼽고 있으며, 이어 타인에 대한 존중과 성별·성적 지향·정치 성향 등에 대한 각종 차별 금지를 명시하고 있다. 또한 성적이거나 폭력적인 콘텐츠에 대해서는, 내용을 일차적으로 가려 별도의 클릭이 있어야만 볼 수 있게 하는 Misskey 기능인 CW 및 NSFW 설정을 적극적으로 사용할 것도 요구하고 있다.

특히 이 인스턴스가 가입하고 있는 릴레이인 No-Stress-Relay(NSR)의 영향으로, 공개 노트 게시에 적용되는 CW 적용 기준은 매우 엄격한 편이다. 단순한 성인물이나 폭력물뿐만 아니라 정치·종교 등 논쟁의 여지가 있는 주제(단순 기사 링크 포함), 부정적인 사건·사고, 외부 커뮤니티의 과열된 화제, 욕설, 특정 대상에 대한 부정적 언급 등 보는 사람에게 피로감을 줄 수 있는 내용은 전부 CW로 가려야 한다. 다만 해당 릴레이의 홈페이지는 현재 접속되지 않아 실제로 작동하는 규칙인지는 불명이다.

수익 창출을 위해 다양한 주체로부터 광고를 유치하고 있으며, 유형은 사용자 계정, 비영리 단체, 비영리 웹사이트, 상업 광고로 구분된다. 단, 사용자 계정 광고는 ActivityPub 내의 특정 계정만 대상이 되며, 타 ActivityPub 인스턴스 자체를 홍보하거나 인스턴스 주소를 광고하는 행위는 금지된다.
